Re: Protection of Property by Use of Section 43, the “Bilateral Amending Formula”
I congratulate you on the work you and Randy Hillier have initiated in Ontario in using section 43 of the Charter to enshrine the protection of property in the Canadian Constitution. The video of your presentation “Paths to Reform” at the September 2012 Canadian Property Rights Conference was most informative.
I am working with a Saskatchewan Party committee looking at how we can protect individual property Rights in Saskatchewan. We are working within the governing Party now, so we have at least a somewhat receptive audience.
Our committee is very encouraged that Dwight Newman has endorsed the method that you and Mr. Hillier are advocating in both his article "The Bilateral Amending Formula as a Mechanism for the Entrenchment of Property Rights" and “The Law of Canadian Constitution” that he and Guy Régimbald co-authored. Dr. Newman certainly seems to believe this “bilateral” method will pass constitutional muster.
Essentially we would like to guarantee the protections that Prime Minister Diefenbaker’s 1960 Canadian Bill of Rights attempted to enshrine. We are only too well aware of how the Courts have circumvented those protections. Thus we realize that the wording of any provincial-federal “bilateral amendment” will be very important to ensure that we achieve our goal.
We would greatly appreciate your assistance in how best to choose the words for our proposed amendment.
